A Greene County jury found Elvin Cruz guilty of aggravated child molestation, aggravated sodomy and incest on Oct. 15 following a three-day trial.
Superior Court Judge Alison T. Burleson sentenced Cruz to life in prison plus 29 years, with one additional year on probation.
According to Captain Lee Stancill of the Greene County Sheriff's Office, Sgt. Don Smith began an investigation into a reported case of child molestation case in January of 2020.
During the investigation, Sgt. Smith learned that the alleged victim was a family member of the suspect, 40-year-old Elvin Cruz. After a thorough investigation, Sgt. Smith sought warrants for the arrest of Elvin Cruz, age 40 of Union Point, for aggravated sodomy and aggravated child molestation.
Cruz was later indicted by a Greene County Grand Jury and charges of incest and two counts of child molestation were added, according to Stancill.
Cruz sought a trial by jury which began on October 12, 2021. After deliberations, the jury found Cruz guilty.
Prosecuting attorney Blayne May of the District Attorney's office said the victim's graphic description of what happened to her played a significant role in the conviction and praised the seven-year-old's courage in relating the events in court.
The Greene County Sheriff’s Office offered congratulations to District Attorneys May and Rebecca Fogel, who prosecuted the case.
